ALLEGED CONVERSION
ESTATE AGENT ACQUITTED AT SMETHWICK SESSIONS
Rowland Arthur Wynn, aged 32, auctioneer and estate agent, was acquitted at Smethwick Quarter Sessions yesterday of a charge of converting to his own use £100 , received by him on account of John Hill, a blacksmith, of Richmond Hill, Langley, on 6th August 1926.
Accused pleaded not guilty.
Mr. Bourke, prosecuting, explained that in August 1926, accused was handed £100 by Mr. William Hadgkiss, a solicitor, for the purpose of paying it to Hill.
The prosecution alleged that accused tried to leave the impression that the money had been paid over, and also that it was properly and securely invested at a high rate of interest.
In June 1926, said counsel, Wynn went to Hill and explained that Mrs McCracken, whose husband had just died, want the £100 with which to carry on until probate was issued.
The money was found and handed to Wynn in notes, while on 1 July Wynn sent his cheque for £100 to Mr.Hadgkiss.
However, Mrs. McCracken did not want the money, and Mr. Hadgkiss sent his cheque for £100 back to Wynn.
Accused, said counsel, cashed that cheque, and it was his duty to have handed the money over to Hill. That, counsel alleged, was not done.
Mr. D. Hirst (for the defence) said that all along Hill had treated the matter as a civil debt.
He did not deny that Wynn had acted very foolishly, but that was not the point.
He asked the jury to leave Hill the remedy that was open to him in the civil courts.
After a deliberation of nearly two hours, the jury found a verdict of “Not guilty,” and accused was discharged.
