A LABOURER'S ACCIDENT

William Bragg, a farmer, of Stockey Down, sued John Bubear of Hatwood [Attwood Cottage Woodland Head Crediton, Crediton Hamlets, Devon, England], Crediton, for £1 10s 3d, seventeen weeks' rent, which was admitted. Bubear however, counter-claimed for £1 0s 3d, damages for injuries sustained, and 13s6d, a week's wages in lieu of notice. Mr. Tarbet appeared for Mr. Bragg and Mr. Bryden for Mr. Bubear.

Bubear said he entered Mr Bragg's employ on June 4th last year, and was to work one day a week for rent, and apart from this received 11s 3d a week. He left on Christmas Eve, having met with an accident through a heavy bar falling on his back.

His Honour asked how defendant could make an accident the ground for a counter-claim. He should have sued under the Workmen's Compensation Act.

Mr. Tarbet agreed, and added that his client admitted thgat an accident did occur.

Mr Dryden submitted an accident could be made the ground of a counter-claim as a set-off.

His Honour said tghere was no cause odf action unless the proper course was pursued. He was sorry for Bubear.

Mr. Dryden thereupon remarked that proceedings would be taken under the Workmen's Compensation Act.

His Honour adjourned the case for Bubear to claim under the Compensation Act. He said it was a nice point whether one could claim damaged for injuries and also wages in lieu of notice. He did not think he could have both.

Mr. Tarbet agreed that he could not claim on both grounds.
