COUNTY COURT December 13
Before John Tyrell, Esq.
THOMAS CLEEVE v. DANIEL HATTIN. – The plaintiff and the defendant are farmers residing at Silverton. – Mr. Floud appeared for Cleeve, who claimed £4, damages sustained by him through 12 of the defendant’s bullocks having trespassed upon his orchard, and eaten and destroyed a quantity of apples and grass growing therein.- The only question at issue was the amount of injury done. The plaintiff and his witnesses estimated it at £4.- The defendant said he offered the plaintiff a hogshead of cider to settle the matter. – Mr. Radmore, of Thorverton, believed that the grass was not worth more than £2, and Mr. Roberts thought that a hogshead of cider would fully compensate the plaintiff for the loss he had sustained. – His Honour ultimately gave a verdict for £2 and half the costs.
Tiverton Gazette, 26 Sept 1876
KILLING GAME OUT OF SEASON – Henry Copp and Daniel Hattin, farmers, of Silverton, were charged with, on 6th September, killing a pheasant out of season. – Mr.Friend, of Exeter, appeared for the defendants, and asked that it may be taken as two separate charges but the Bench did not consider it necessary. P.C.Dodd, Siverton, gave evidence of a lengthy character as to seeing the defendant Copp shooting at the pheasant and Hattin putting it into his pocket and refusing to allow him to see what it was.- Mr. Friend having replied for the defence, he called Emma King, Mr.Hattin’s cook, who swore that in her opinion there were no shots in it, and that the two marks were those from a dog.- The Bench having retired on returning into court, the Chairman said they had come to the conclusion to convict both defendants, and they would be fined 10s each including costs.

TIVERTON COUNTY COURT
SATURDAY, SEPTEMBER 8TH, before Mr. Sergeant Petersdorff, (judge).
Mr. Bartlett, v. Daniel Hattin. – The claim was for 12s for an empty cask which was supplied with beer in June 1874, and alleged never to have been returned. The plaintiff said he had written after it ten, or a dozen times at least, and had never had any reply. Plaintiff said he carried plaintiffs letters to Mr. Hames, the carrier, who told him it was all right as he had delivered the cask. He did not know anything about Mr. Bartlett’s claim. Mr. Hames stated that he carried goods from Tiverton to Silverton and returned a cask to Mr. Bartlett on the 15th September 1874. He took it to Mr. Bartlett’s premises in Tiverton. – In reply to his Honour the witness said the Tiverton people never paid for the carriage of anything. He could not say who had the cask, but he put it on the plaintiff’s premises. This was the third time there had been a dispute. – Plaintiff said it was quite possible that the cask might be brought and left in the front of his house without any person being informed of it. - His Honour said he should non-suit the plaintiff without costs. –Plaintiff thought it was very hard that defendant did not reply to his letters. – His Honour thought it was to be regretted.

TIVERTON COUNTY COURT
Daniel Hattin, of Teignmouth, yeoman, v. W. Vaughan, of Union Road, Exeter, hay-dealer. –The claim was for £40 13s including debt and costs. – On 26th March 1877, before leaving Silverton for Teigmouth, Hattin had sold a rick of hay to Vaughan, he claimed for a ton of mangold and £38. There had been some discussion as to why the hay could not be sold by the seam, but Hattin said that he was leaving for Teignmouth and had no labour to deal with that, Three months after the sale Hattin sent in his bill, but despite several times of asking nfor payment, Vaughan had not paid the bill and had failed to meet with Hattin to discuss it. The defendant claimed that the rick contained 10 to 20 seams of frouzy or bad hay and thate he coukld not sell most of it. Both sides made claims and counterclaims about the condition of the rick at the time of its sale, backed up by witnesses. Thw Judge determined that with good such as hay, it was importantbthat the buyer established the state of the item at the time of the sale and rejected bad quality then. This had not been the case. The moment that he found thatthe matter did not correspond with the warranty he was bound without delay to return it, or if he elected to take any part of it, it was at his own discretion and he thereby forfeited all his right under the warranty. He directed the jury to give their verdict for the plaintiff.
16 Mar 1875 Devon Lent Assizes. James Miller, 19, labourer, pleaded guiltynto obtaining by false pretence, from Daniel Hattin, at Silverton, on 9 February.
